  1. Introduction

 

Please read carefully these Terms and conditions, and do not use my services unless You accept its provisions and acknowledge them as legally binding upon yourself.

 

These Terms and Conditions (hereinafter: “Terms”) apply to the sale of products by the self-employed Julianna Edina Ilyés (hereinafter: “Seller”) on the web page www.ilyesjuli.hu (hereinafter: “Web Page” or “Webshop”) and determine the terms of the legal relationship between the Seller and the buyers on the Webshop (hereinafter: “You” or “Buyer(s)”). The conditions set forth in these Terms are applicable to the purchases made in the Webshop. By purchasing in the Webshop, You accept the provisions of the Terms, and the Terms in their entirety become part of the contract between You and the Seller.

The Seller is entitled to modify the provisions of the Terms according to the applicable laws. The modification of the Terms becomes effective after it is published on the Web Page. The current modification does not affect the already executed contracts (acknowledged orders).

 

Hungarian is the language of the contracts that are subject to the Terms.

 

The contracts that are subject to the Terms are not written contracts, the Seller does not file them.

 

There is no code of conduct regarding the Seller as set forth in the Act on the prohibition of unfair business-to-consumer commercial practices; the Seller is not subject to any code of conduct.

  1. The contract’s subject-matter and terms

 

Products

 

The products sold on the Web Page are costume jewellery designed and manufactured by the Seller; these are unique, hand-made design jewellery. The jewels are made of aluminium and silver-gold plated copper. The jewels can be cleaned with soapy water; however, no acidic, corrosive materials can be used during cleaning. The parts of the jewels are made of stainless steel, they are antiallergenic.

The substantive properties of the products, that are available in the Webshop, are detailed in the descriptions of the given product. The photos are sometimes illustrations, it is the characteristic of photo illustrations that certain details (such as colours) are not always accurate.

 

The process of purchase and order

 

Registration is not necessary for the purchase; however, it is possible to create a customer account during the purchase process to facilitate future purchases. The customer account can be accessed on the Web Page by choosing the “My account” under the “Shop” menu item or by pressing the “Login/Sign up” button on the upper right corner of the Web Page. A customer account can be created during the ordering process as follows.

 

The product on the Web Page can be accessed by pressing “Store” under the “Shop” menu item. Choose the suitable product from the Webshop by clicking on the product’s name or picture and press the “Add to cart” button to put them in the cart.

 

The current content of the cart can be displayed by pressing the cart icon on the upper right corner of the Web Page or by choosing “Cart” under the “Shop” menu item. The Buyer can delete the content of the cart by pressing the “Delete my cart” button.

 

After You chose the suitable products as described above, and You do not want to add any more products to the cart, You can finalize the content of the cart by pushing the “Check out” button. The Buyer can return to the Store menu item of the Webshop by pushing the “Return to the shop” button.

 

You can use the discount coupon by adding the coupon code in the “Cart” menu item and pressing the “Submit“ button. For further information on the discount coupons see below the “Newsletter, coupon” point.

 

The Buyer provides the following data in the “Check out” menu: first name, last name, company name, street name, house number, flat, suite, etc. (not required), city, zip code, telephone number, e-mail address

 

The Buyer can create a customer account with the submitted data by selecting the “Create account?” checkbox. You need to provide a password to create a customer account.

 

The Buyer can add comments on the order or the shipment under the “Additional information” text. The Buyer can choose the payment method to be used under the “Payment information” text.

 

The sales contract of the products in the cart is executed between the Seller and the Buyer with the data on the order that was filled out according to the above-mentioned rules and with the conditions determined in the Terms. Therefore, it is very important to submit accurate data above.

 

The Web Page will ask the Buyer to check the box on the “Check out” page, if the Buyer understands and accepts the provisions of the Terms. Please read your order carefully before finalizing it. The order is finalized by pressing the “Submit order” button. You expressly acknowledge by pressing the “Submit order” button that your offer is deemed to have been made, and Your statement results in a payment obligation, if the Seller accepts it according to these Terms.

 

You can modify the added data during the ordering process before finalizing the order (if You click on the “Previous” button on the browser, the previous page opens, therefore, the added data can be modified even when You have proceeded to the next page). You acknowledge by submitting the order that the Seller is entitled to hold You responsible for any damages and costs arising out of the incorrect data input and the inaccurate data. The Seller waives her responsibility for the performance based on incorrect data input. Please note that the acknowledgement may not be delivered properly, if the submitted e-mail address is inaccurate or the mailbox is full, and this can prevent the execution of the contract.

 

The Buyers should note that the products sold by the Seller are unique, hand-made works of applied arts. Therefore, the production of each product can have small differences from the depiction and description displayed on the Web Page. Please take this into consideration when You send your order to me.

 

The products offered on the Webshop are only available for online purchase. The products of the Webshop cannot be ordered by e-mail or phone. The information on the Web Page are updated regularly; however, I am not responsible for any inaccuracy, unintentional mistakes or typos that may occur.

 

As a result of a technical error, incorrect price may be displayed on the Web Page. If an incorrect price is displayed, I cannot accept your order (your offer) with the incorrect price and I am not obliged to sell You the product at the incorrect price. If the offer was made with an incorrect price, then the contract is not executed between us. If You make your offer with the incorrect price, and the system automatically acknowledges it that does not mean the acceptance of the offer on our part. If the offer was made with an incorrect price, the Seller can notify You of the correct price and can offer You a contract with the correct price. You are not obliged to make an offer and enter into a contract containing the correct price notified by the Seller. In this case, there is no contract between the parties.

 

Certain products on the Web Page has “Out of stock” status, their production takes longer. Please take this into consideration during the ordering process.

 

The products can be ordered on the Web Page until the stocks are exhausted.

 

I will acknowledge your order within 48 hours after its submission in an e-mail sent to the e-mail address provided on the order. If You provided inaccurate information tha is required in the ordering process, I cannot acknowledge or fulfil your order. I am not responsible for the inconveniences and damages arising from the inaccurate filling out of the order. If the acknowledgement is not delivered to the Buyer within 48 hours after the order’s submission, the offer is no longer binding on the Buyer.

 

The order and its acknowledgement are deemed to be delivered to the Seller or to the Buyer (respectively), when it becomes accessible to them.

 

The acknowledgement solely proves the receipt of the order and not its acceptance, i.e. it does not prove that the parties entered into a contract. The sales contract regarding the ordered products is executed between the parties when the Seller notifies the Buyer in an e-mail about the acceptance and performance of the order, i.e. about the fact that the products have been handed over to the carrier. If I cannot perform the order in accordance with the conditions determined in the Terms for any reason, I notify the Buyer of this fact in an e-mail after the acknowledgement of the order as soon as possible.

 

If the Buyer provides an incorrect shipping address on the order, and the shipment becomes impossible as a result, the Seller is not responsible for the failure of performance. In this case, the Buyer notifies the Buyer in question within 5 working days after becoming aware of the failure of shipment and prompts the Buyer to provide a correct shipping address. If the Buyer requires repeated delivery of the product to the provided correct address, the Buyer bears the shipment costs. If the Buyer does not provide a correct shipment address, the contract terminates, and the Buyer bears the shipment costs that was incurred as a result of the inaccurate shipment address.

 

Newsletter, discount coupon

 

You can sign up to newsletters on the Web Page. The Seller will send at least one newsletter per month to those who signed up to newsletters.

 

By signing up to newsletters, the Buyer gives an explicit and voluntary consent to me to send correspondence for direct marketing purposes to the contact information the Buyer provided to offer the Buyer a personalized compilation of news, offers and other information.

 

If the Buyer no longer wants to receive newsletters, the Buyer can opt out and unsubscribe any time. The Buyer can unsubscribe by clicking on the link in the newsletter and following the unsubscription process. The Buyer can also send an e-mail to the ilyesjulianna@gmail.com address in which the Buyer withdraws the consent to receive newsletters.

 

The Seller may send discount coupons at her own discretion in a newsletter to the subscribers from time to time.

The coupon contains the following: a password/coupon code, the rate of discount in percentage or its exact amount, and its validity period.

When the Buyer makes a purchase on the Web Page within the validity period displayed on the discount coupon according to the provisions of the Terms and fills out the “Please enter the coupon code” box with the referenced password/coupon code, the discount determined on the coupon will be applied to the total amount of the purchase.

 

Prices and other costs of the purchase

 

The prices next to the products are displayed in HUF.

The prices next to the products are displayed in gross amounts, they contain VAT.

The Buyer has to pay the shipment costs in addition to the price of the products. The shipment costs include the costs of packaging and shipment.

The shipment costs are determined in the parcel delivery price list of the carrier company currently in a contractual relationship with the Seller (it is the DPD Hungária Kft., cím:1158 Budapest, Késmárk u. 14., Hungary at the moment) to the deliveries in Hungary and Europe.

 

Therefore, the shipment costs of the domestic delivery of a parcel above 3 kg are the following at the effective date of the Terms:

In case of bank transfer, payment through Barion and PayPal per package:

  • 01-3.00 kg 1141 HUF+VAT
  • The shipment is free, if the total amount of the purchase exceeds 20 000 HUF.

 

The DPD makes shipments in 29 countries within Europe (for the prices determined at the execution of the contract) with the following conditions (the numbers indicated at each country are the projected shipment time. They are for information only, and have no binding force):

 

Zone 1: Austria (1-2), Slovakia (1-2), Croatia (1-2), Slovenia (1-2)

Zone 2: Germany (2-3), Czech Republic (2-3), Poland (3), Romania (2), Belgium (3-4), the Netherlands (3-4), Switzerland* (4-5), Lithuania (4-5)

Zone 3: Denmark (4), Bulgaria (3), France (4), Estonia (4-5), Latvia (6), Sweden (4-5), Ireland (5), Luxemburg (3-4), Italy (3-4), England (4-5)

Zone 4: Spain (4-5), Finland (4-5), Norway* (4-5), Greece** (3), Portugal (4-5), Bosnia and Herzegovina* (5-6), Serbia* (5-6)

 

* In case of a country marked with this sign, the shipment time can be extended by the time of customs clearance

** In case of Greece, the DPD applies 3.6 EUR surcharge for Crete and 11 EUR surcharge for the other islands.

The shipment costs can change according to the modification of the carrier’s price list which I will publish in the Terms every time.

 

Payment terms

 

The ordered products can be paid by bank transfer, and electronically through Barion and PayPal. The payment method can be selected on the “Payment information” menu item of the “Check out” page.

If the Buyer chose bank transfer, payment through Barion or PayPal in the order, and the price of the ordered products are not paid within 8 working days after the acknowledgement of the order, the order is no longer binding on the Seller and she is not obliged to fulfil the order.

The Seller will send the invoice about the price of the products and the shipment costs to the Buyer together with the products.

 

Delivery terms

 

After the order is placed, and the payment is made by bank transfer or through Barion or PayPal payment systems, the ordered products are handed over to the carrier within 5 working days after the price of the ordered products are paid by the Buyer and it is received by the Seller. The products are handed over to the carrier service in a packaging that keeps them unharmed: in a unique paper box with a logo that is placed in a padded envelope. The ordered product will be delivered to the costumer’s home by the DPD Hungária Kft. The internal regulations of the DPD Hungária Kft. determine the delivery deadline.

Please inspect the package in the presence of the deliverer to see, if it is undamaged. If You see any damage, ask for a record and do not accept the package.

 

To facilitate the withdrawal from the contract, please request a proof of the receipt date of the parcel from the deliverer; or ask the deliverer to sign and date the wrapping of the delivered parcel or the receipt that is provided to the Buyer which I ask You to retain. If You want to exercise your right to withdraw from the contract as described below, please attach a copy of this receipt to your withdrawal statement.

 

  1. The right to withdraw from the contract

 

According to Government Decree 45/2014. (II. 26.) on the Detailed Rules of the Business-to-consumer Contracts, the Buyer is entitled to withdraw from the sales contract regarding the product without giving any reasons within 14 days from the receipt of the product (in case of multiple products that were delivered at different times, from the receipt of the last product). This rule does not affect the Buyer’s right to withdraw from the contract between the date of the contract’s execution and the receipt of the product.

 

If the Buyer withdraws from the contract, the Seller is obliged to refund the purchase price paid for the product and the shipment costs to the Buyer within 14 days of being informed of the withdrawal. The Seller can withhold the amount that is refundable to the Buyer until the Buyer sends back the product or gives proof without a doubt that it has been sent back; whichever is the earlier date. The Seller cannot receive those parcels that are sent with cash on delivery.

 

If the Buyer expressly chooses a shipment method that is different from the usual, most cost-effective shipment method, the Seller is not obliged to reimburse the extra costs occurred as a result. In such case, the refund obligation only extends to the listed general delivery prices.

 

The Buyer is responsible for the deterioration that is the result of any use that exceeds the use that is necessary to determine the nature and properties of the product. Therefore, the Seller is only obliged to refund the whole purchase price to the Buyer, if the product is sent back undamaged.

 

 

If You want to withdraw from the contract, You can do that in writing referring to the product and the order ID.

 

If the withdrawal is notified by mail, the Seller counts the 14 days from the posting of the letter. Please send the letter as a registered letter so the date of posting can be proven without a doubt.

 

Please use the following statement form to exercise your right to withdrawal:

If the Buyer withdraws from the contract, the product must be sent back or handed to the Seller without delay, but no later than 14 days after the notification of the withdrawal. If the Buyer sends the product before the deadline, the product is deemed to be sent back in time.

 

Please send back the product that is subject to the withdrawal according to the above-mentioned provisions to my address (Ilyés Julianna Edina, 2162 Őrbottyán, Harang utca 112., Hungary). The Buyer bears the costs arising from the withdrawal.

 

In case of withdrawal, the Seller will refund the repayable amount to the Buyer with the same payment method that was used by the Buyer or with another payment method that is expressly accepted by the Buyer. The Seller is not responsible for any delay that is the result of a wrong and/or inaccurate bank account number or postal address that was provided.

 

  1. Guarantee, warranty

 

The Sellers offers one-year guarantee for the products available in the Webshop. Please use and clean the product as described in the instructions for its use and handling because the Seller waive any responsibility for damages arising from a use that is not in accordance with its intended use. The guarantee is not applicable to a product that was not used in accordance with its intended use, and the Seller has the expertise, therefore, her statement shall be recognized as determinative whether the product was used in accordance with its intended use or not.

 

The Seller is obliged to provide guarantee or warranty only if the product is faulty and the cause of the fault was already present at the time of the purchase.

 

If the Seller does not have to provide guarantee or warranty for the product that was sent back according to the above described provisions, then the Buyer will be notified of this fact and the product will be sent back with cash on delivery to the Buyer at the Buyer’s expense. Furthermore, the Seller bears the costs of the fulfilment of a well-founded guarantee or warranty claim (including the cost of repair/replacement and the delivery).

 

The Seller gives the following notification regarding the exercise of implied warranty, product warranty and guarantee rights.

 

Implied warranty

 

When can You exercise your implied warranty right?

 

If the Seller’s performance is non-conforming, You can assert implied warranty claim against the Seller according to the provisions of the Hungarian Civil Code.

 

What rights do You have in connection with your implied warranty claim?

 

You can choose (in your sole discretion) from the following implied warranty claims:

 

You can claim the repair or the replacement of the product, except when the claim You chose is impossible or it would cause the Seller disproportionate extra costs compared to the fulfilment of other claims. If You do not or cannot choose the repair or the replacement of the product, then You can claim the proportional decrease of the product’s price; or You can repair it or have a third party to repair it at the expense of the Seller; or You can withdraw from the contract as a last resort.

 

You can switch from your chosen implied warranty claim to another, but You have to bear the costs of the switch, unless it was justified or the Seller provided a reason for the change.

 

What is the deadline for You to exercise your implied warranty claim?

 

You have to send notification of the fault without delay, but no later than two months after its discovery. However, please note that You cannot exercise your implied warranty rights after the limitation period that is two years after the execution of the contract.

 

Against whom can You exercise your implied warranty claim?

 

You can exercise your implied warranty claim against the Seller.

 

What are the further conditions to exercise your implied warranty claim?

 

There are no other conditions to exercise your implied warranty claim within six months after the performance than to give notification of the fault, if You can prove that the product or the service was provided by the Seller. However, it becomes your responsibility more than six month after the performance to prove that the fault You discovered was present at the time of the performance.

 

Product warranty

 

When can You exercise your product warranty right?

 

You can choose at your sole discretion between the implied warranty claim and the product warranty claim, if the fault is in movable property (product).

 

What rights do You have in connection with your product warranty claim?

 

As a product warranty claim, You can solely request the repair or replacement of the faulty product.

 

When is the product deemed to be faulty?

 

The product is faulty, if it is not in compliance with the quality requirements at the time of marketing or does not have the properties that are in the description provided by the manufacturer.

 

What is the deadline for You to exercise your product warranty claim?

 

You can exercise your product warranty claim within two years after the product is marketed by its manufacturer. You lose your right after this deadline.

 

Against whom and with what conditions can You exercise your product warranty claim?

 

You can exercise your product warranty claim solely against the manufacturer or the distributor of the movable property. You have to prove the fault of the product when You exercise your product warranty claim.

 

When is the manufacturer exempt from the product warranty obligation?

 

The manufacturer is exempt from the product warranty obligation, if the manufacturer can prove that:

 

– the product was not manufactured or distributed as part of its business operation; or

– the fault was undetectable at the current state of science and technology at the time of the marketing; or

– the fault of the product is the result of compliance with the applicable laws or mandatory regulations.

 

The manufacturer is required to prove only one cause to be exempt.

 

Please note that You cannot parallelly exercise both implied warranty and product warranty claim at the same time for the same fault. You can exercise your product warranty claim against the manufacturer for the replaced product or the repaired part.

 

Guarantee

 

When can You exercise your right to guarantee?

 

If the performance is non-conforming, the Seller is obliged to provide guarantee, according to the Terms and the applicable laws on mandatory guarantee.

 

What rights and deadlines do You have based on the guarantee?

 

Government Decree 151/2003. (IX. 22.) on the Mandatory Guarantee on Certain Consumer Durables determines the cases of mandatory guarantee. The Seller provides one-year voluntary guarantee as described above to those products that do not fall into these categories.

 

The guarantee claim can be exercised within the guarantee period. If the party that is obliged to offer guarantee does not fulfil this obligation within an adequate period of time at the request of the right holder, the guarantee claim can be exercised before court within three months after the deadline set forth in the request even when the guarantee period has already passed. The failure to meet this deadline results in loss of right. In other questions, the rules for the exercise of implied warranty claim have to be applied mutatis mutandis to the exercise of guarantee claim. The guarantee period is one year. The failure to meet this deadline results in loss of right. The guarantee period starts when the consumer goods are delivered to the consumer; or when the consumer goods are installed, if it is performed by the company or a third party on the company’s behalf.

 

According to Government Decree 151/2003. (IX. 22.) on the Mandatory Guarantee on Certain Consumer Durables, there is mandatory guarantee in case of watches and jewels with purchase prices above 10 000 HUF.

 

When is the Seller exempt from the guarantee obligation?

 

The manufacturer is exempt from the guarantee obligation, solely if the manufacturer can prove that the cause of the fault arose after the performance.

 

Please note that You cannot parallelly exercise both implied warranty and guarantee claim, or product warranty claim and guarantee claim at the same time for the same fault; however, in other instances You can exercise your guarantee claim independently from your warranty claims.

 

  1. Complaint-handling, exercise of consumer rights

 

If the Buyer has any objection or complaint about the Web Page, the executed contract or its performance, the Buyer can communicate them in an e-mail, on the phone or by mail to the Seller using the contact information set forth in Point 2 (Seller).

 

The Seller addresses the oral complaint without delay and remedies it, if it is required and the nature of the complaint allows it. If the complaining party does not agree with the addressing of the complaint or the immediate addressing of the complaint is not possible, the Seller makes a record of the complaint and her opinion, and provides a copy of it to the complaining party personally in case of an oral complaint, or in case of a complaint made on the phone, sends it together with the substantive reply determined in the part on the written complaint at the latest; and hereinafter follows the provisions regarding the written complaint.

 

The complaints can be identified and retrieved according to the customer number; if the complainant does not have these numbers, the Seller will give the submitted complaint a unique ID number.

 

The Seller is obliged to assess the written complaint within thirty days after its receipt and give a substantive reply; and ensure that the answer is delivered to the complainant. If the Seller rejects the complaint, she has to provide a justification in the substantive reply containing the rejection.

 

The Seller archives the e-mails in connection with the complaints and retains a copy of the records of the complaints and the answers.

 

If the Seller and the Buyer cannot settle their consumer dispute by negotiations, the following enforcement options are available to the costumer:

 

(i) The Buyer is entitled to initiate a procedure at the reconciliation committee that is competent according to the Buyer’s place of residence or stay:
